What Are New York’s Grounds for Divorce?

New York is different from every other state in that the only “no fault divorce” is where a valid legal separation agreement has been signed. Some valid reason, also known as grounds for divorce, must be presented to the court in order for it to issue a divorce decree.

  • Abandonment
  • Physical abandonment for at least a year
  • Lockout abandonment for at least a year
  • Sexual abandonment for at least a year (constructive abandonment)
  • The marriage has been irretrievably broken for a period of six months as stated under oath by one party
