Recently, the state of New York amended certain laws pertaining to divorce, spousal support and modifications of spousal support. The first of these changes affects grounds for divorce. Now, if one party claims, under oath, that the marriage has been irretrievably broken for a period of six months or more, the court will accept this as grounds for divorce and allow a petition to be filed.

Others changes impact spousal support. Temporary spousal support, put in place while the divorce process is underway, will now be determined by a specific formula. A law concerning the presumption of counsel fees for a non-moneyed spouse has been added. In addition, there has been a change in the laws regarding the modification of orders of support.
