Arriving at a Child Support Amount Can Be Challenging
Under New York law, child support is set by standard guidelines. The factors that determine the amount of child support are the incomes of each parent and the number of children. Under the uniform guidelines, certain expenses such as uninsured medical costs and child care are included in child support. Extracurricular activities and educational expenses may be awarded, in the discretion of the court.
Judges have some discretion in setting child support amounts, and parents can even agree to a support level outside the guidelines, but the Court must be presented with compelling evidence that this is in the best interest of the children involved.
